DUI Arrest

Police said they received a report of a motorist driving erratically near the intersection of Hawleyville Road and Mt Pleasant Road late on the night of December 27, so they went to the area to investigate.

Police said they found the vehicle that had been described to them in the parking lot at Hot Shots Grille at 130 Mt Pleasant Road.

Police said that after an investigation, they charged the vehicle’s driver, Aguilar Montero Modesto, 32, of Danbury with driving under the influence. After arrest processing, police released Modesto on $500 bail for a January 13 court appearance.

Three Youths

About 8:30 pm December 28, police stopped a vehicle on Main Street after its driver had violated a motor vehicle law, they said.

Police charged the driver with failure to obey a stop sign, possession of less than four ounces of marijuana, possession of alcohol by a minor, and possession of tobacco by a minor.

Also, police charged one passenger with possession of less than four ounces of marijuana and with possession of tobacco by a minor. Also, police charged another passenger with possession of less than four ounces of marijuana.

Because all three youths are either age 16 or 17, they are categorized as “youthful offenders,” and thus their identities are shielded from public disclosure.

All three youths were turned over to their parents, police said. The youths are scheduled to appear in Danbury Youthful Offender Court on January 16 to answer the charges.

Middle School

After she learned that police held a warrant for her arrest, a female Newtown Middle School student turned herself over to police on the morning of December 29, and was charged with third-degree assault and with breach of peace, police said.

Police allege that the girl, who is under age 16, struck another middle school student while that student was walking in a hallway in the school on October 28.

State law shields the identities of people under age 18 who are charged with crimes. Police released the arrested girl into her mother’s custody for a January 12 appearance in Danbury Juvenile Court.

MV Violations

Motorist Janice Tuttle, 52, of Norwalk was driving a 2005 Toyota Highlander SUV southward on Botsford Hill Road, near Little Brook Lane, in snowy conditions midday on December 19, when the SUV slid on the snow-covered road and struck an unidentified vehicle whose driver was turning that vehicle around in the roadway, police said. There were no injuries.

Police charged Tuttle with traveling too fast for conditions and with driving with a suspended license. Police released her on $100 bail for a January 2 court appearance.

Church Hill Crash

Police report that motorist Bogdan Grzybowski, 51, of 8 Old Green Road was driving a 1995 Chevrolet G-30 van westward near 47 Church Hill Road about 9:48 am December 27, when he drove toward the center of the road in preparing to make a wide right turn.

Westbound motorist James Richards, 37, of 10 River Edge Drive , who was driving a 2008 Toyota Sienna minivan behind the Chevrolet, then attempted to pass the Chevrolet on the right but collided with it, police said.

There were no injuries. Police issued Richards a written warning for passing on the right.

Icy Road

Motorist Sandra Gilbert, 65, of Brookfield was driving a 2000 Subaru Legacy station wagon southward on Obtuse Road about 8:30 am December 29, when she lost control of the vehicle on the icy pavement, police said.

The Subaru then went across the northbound lane and struck a stone wall, police said. Gilbert was not injured. Police took no enforcement.

Windy Day

Motorist Karen Ann Alves, 36, of 58 Jeremiah Road was driving a 2008 Ford Explorer SUV southward near 159 Toddy Hill Road during high-wind conditions about 9:48 am December 30, when a tree fell across the road, striking the vehicle, police said.

The falling tree damaged the SUV’s windshield, roof, and sunroof. Neither Alves, nor an infant passenger, were injured, police said. Police took no enforcement.

Fallen Tree

At about 9:45 am on a windy December 30, a tree fell across the road near 25 Underhill Road, with a piece of the fallen tree striking a Honda Civic, which was parked in front of that address, police said.

Police called the town public works department to remove the fallen tree.

Minivan Vs SUV

Police report a two-vehicle accident on Wasserman Way, at its intersection with Berkshire Road, at about 7:38 am December 23.

Motorist Daniel O’Connor, 16, of 8 Old Farm Hill Road, who was driving a 2001 Toyota Highlander SUV, was standing still on Wasserman Way when the SUV was struck from behind by a 2002 Chevrolet Venture minivan driven by Alexandra Kirk, 16, of 5 Benjamin Drive, police report

There were no injuries. Police gave Kirk a written warning for traveling an unreasonable distance apart, police said.

Slippery Street

Motorist Charles Speruzzi, Jr, 60, of Brookfield, who was driving a 2001 Dodge Dakota pickup truck northward near 3 Obtuse Road about 10:40 pm December 25, skidded on the icy pavement, went off the right side of the street and struck a snowbank, police said.

Speruzzi was not injured. Police issued him a written warning for making a restricted turn.

Sunnyview Terrace

About 4 pm on December 25, motorist Gulraiz Ansari, 47, of 14 Sunnyview Terrace, who was driving a 2001 Ford Windstar minivan, was backing out of a driveway at 5 Sunnyview Terrace, after which the rear end of the minivan struck a curbside residential mailbox at 6 Sunnyview Terrace, police said. Ansari received a written warning for unsafe backing, according to police.

DUI Arrest

According to court documents received by The Newtown Bee on September 11, 2018, this case was dismissed on March 5, 2010.

Police report that while on patrol for drunken drivers at about 1:15 am December 29, they stopped motorist Edward Gries, 29, of Danbury for speeding on Berkshire Road, near its intersection with Toddy Hill Road.

After giving Gries field sobriety tests, police charged him with driving under the influence, possession of drug paraphernalia, and speeding.

Police said that after Gries was placed in a holding cell in the police station where he was being held on $500 bail, Gries damaged the cell’s bed and then intentionally flooded his cell and nearby rooms, causing an unspecified amount of water damage to town property.

Police thus additionally arrested Gries on two counts of third-degree criminal mischief.

Gries was arraigned on the five offenses that morning in Danbury Superior Court, police said. After arraignment, the court released Gries on a written promise to appear in court on January 20 to make pleas in the case.

 

Automotive Vandalism

Police are investigating several cases of vandalism to automobiles that occurred overnight January 1 to January 2.

Several vehicles’ window glass were vandalized in areas including Walnut Tree Hill Road, Chipmunk Trail, Hattertown Road, and Aunt Park Lane, police report.

Police said that sometime between 12:30 and 1:30 am on January 2, someone apparently used a BB-gun or an air rifle to damage the windshields on two vehicles parked near 159 Walnut Tree Hill Road and to damage the right rear window on a vehicle parked near 27 Chipmunk Trail. The aggregate value of the damage received by those three vehicles exceeds $1,500, which constitutes a case of first-degree criminal mischief, police said.

People with information on the vandalism incidents are asked to contact either Officer Matthew Wood or Officer Larissa Nosal at the police station at 3 Main Street, telephone, 426-5841.

Toddy Hill Road

About 3 pm December 27, motorist Martha Manion, 48, of 36 Toddy Hill Road, who was driving a 2006 Honda SUV with one passenger northward on Toddy Hill Road, slowed in order to make a left turn into her driveway, police said.

A red SUV, which was possibly an Oldsmobile Bravada, that was traveling northward behind the Honda, then attempted to pass the Honda on the left but collided with the Honda, resulting in both vehicles coming to rest in the driveway, police said. There were no injuries.

The driver of the red SUV then backed up and drove away from the accident scene, police said. Police ask anyone who knows the identity of the fleeing driver to contact Officer Steven Borges at the police station at 3 Main Street, telephone, 426-5841.

Snowy Road

About 12:15 pm December 31, under snowy conditions, motorist Matthew Ritchie, 24, of Wilmington, N.C., was driving a 2004 Honda CRV northward on Farview Drive and approaching its intersection with Brook Bridge Drive, when he attempted to slow the vehicle, but skidded on the snowy roadway, lost control of the vehicle, went off the roadway and down an embankment, police said.

Ritchie was not injured. Police said they issued him an infraction for driving an unregistered vehicle.

Honda Vs Saab

Police report a two-car accident on a snowy Brennan Road about 10:25 am December 31.

Motorist Neal DeYoung, 47, of 9 Gopher Road, who was driving a 2003 Honda Accord sedan westward on Currituck Road, made a right turn and was traveling northward on Brennan Road when he slid onto that road’s southbound lane, police said.

Motorist Gregory Martiska, 45, of 15 Gopher Road, who was driving a 2001 Saab 9-5 station wagon carrying three passengers southward on Brennan Road, then stopped for the approaching Honda, police said.

DeYoung braked, but the Honda would not stop in time and collided with the Saab, police said. There were no injuries. Police issued DeYoung a written warning for traveling too fast for conditions.

Drug Warrant

Police said they went to the home of Patti-Jean Roberts, 45, of 6-A Meadow Brook Road about 1 pm January 1, and charged her with possession of less than four ounces of marijuana and with possession of drug paraphernalia in connection with a past motor vehicle incident.

After processing the charges, police released her on $100 bail for a January 15 court appearance.

MVA Warrant

After learning that police held a warrant for his arrest, Saber Khouri, 64, of Tannersville, N.Y., went to the police station on January 2 and was charged with reckless driving, making a restricted turn, and failure to have automotive insurance, police said.

The charges stem from a one-car motor vehicle accident that occurred October 22 near 148 Berkshire Road in which the Volvo sedan that Khouri was driving went out of control, hit a utility pole and then rolled over, landing on its roof in a front yard.

Police released Khouri on $100 bail for a January 16 court appearance.

Lost Wallet

Police learned on the afternoon of January 2 that a person had lost a black leather bifold wallet about 11:30 pm December 31, either in the area of Dunkin’ Donuts at 6 Queen Street or at the commuter parking lot on Hawleyville Road (Route 25), just north of Exit 9 of Interstate 84.

If the wallet is found, police ask that the finder turn it in at the police station at 3 Main Street.

DUI Arrest

Police report that they found motorist John McNulty, 53, of 73 Cedar Hill Road asleep at the wheel in the driver’s seat of a running vehicle that was parked at Sand Hill Plaza at 228 South Main Street about 11:10 pm December 29.

An investigation indicated that McNulty was under the influence of alcohol at the time, police said.

Police charged him with driving under the influence. McNulty was released on $500 bail for a January 13 court appearance.

Cellphone

After he was spotted using a handheld cellphone while driving on Church Hill Road, police stopped motorist Robert Berube, 39, of 55 Sugar Street to investigate at about 6:40 pm January 3, police said.

Police charged Berube with illegal use of a handheld cellphone while driving and also with driving with a suspended license.

Police released Berube on $200 bail for a January 20 court appearance.

Bogus Check

On the afternoon of January 2, Monique Harrison, 22, of Brooklyn, N.Y., attempted to cash a forged check for approximately $900 at Chase Bank at 30 Church Hill Road, police said.

It was learned through an investigation that Harrison had cashed a forged check at that bank one week earlier, police said.

Police charged Harrison with third-degree forgery and with criminal attempt to commit fourth-degree larceny in connection with the January 2 incident.

Police held Harrison on $10,000 bail for a January 5 court arraignment on the charges.

Youth With Drugs

Police report they observed a suspicious vehicle parked at the turnaround circle at Lone Oak Meadows Road in Sandy Hook about 10:30 pm January 3, so they investigated.

A youth who was sitting in the front passenger seat of that vehicle possessed marijuana, police said.

Police charged that person with possession of less than four ounces of marijuana. Police released the youth on a written promise to appear January 23 in Danbury Youthful Offender Court.

The person arrested in the case is a “youthful offender,” meaning they are either 16 or 17 years old. The identities of people under age 18 who are charged with crimes are shielded from disclosure by state law.

Bridgeport Man

About 1:23 pm January 4, police spotted a vehicle with darkly tinted windows on Church Hill Road, so they stopped its driver to investigate.

The driver did not have the state permit decal which allows motorists to have darkly tinted windows on vehicles.

Police then charged motorist Rafael Hostos, 25, of Bridgeport with failure to have a state tinted-window permit and with driving with a suspended license.

Police released Hostos on $100 bail for a January 15 court appearance.

Warrant Arrest

State police report that at about 10:15 am January 3, they took William T. Robinson, Jr, 38, of West Haven into custody on Route 34 and charged him on a warrant with second-degree harassment in connection with an unspecified past incident.

After he posted $1,000 bail, Robinson was released for a January 12 appearance in Derby Superior Court.

DOT Truck

State police report a collision involving a state Department of Transportation (DOT) dump truck and a Honda Civic on eastbound Interstate 84, west of the Rochambeau Bridge, about 9 am January 3.

Motorist Maria Shoemaker, 21, of Latham, N.Y., was driving the Honda in the right lane of two lanes, as DOT driver Jeffrey Calo, 49, of Woodbury was driving a DOT 1993 International dump truck in the lane to the left of the Honda, state police said.

The DOT truck then attempted to enter the right lane, but collided with the Honda, state police said. There were no injuries. State police verbally warned Calo for making an improper lane change.

DUI Charge

Police said they responded to a report of a problem at the intersection of Miya Lane and Cherry Street in Sandy Hook on the afternoon of January 1.

On investigating, police said they gave motorist Jeffrey Stanton, 53, of 15 Miya Lane a set of standardized field sobriety tests. Police said they then charged Stanton with driving under the influence.

After processing the case, police released Stanton on $100 bail for a January 15 appearance in Danbury Superior Court.

Sedan Hits Pole

Motorist Ryan C. Nezvesky, 27, of 9 Old Town Road told police that he was driving a 2002 Acura TL sedan on Boggs Hill Road, near its intersection with Spring Road, early on the morning of December 28, when he veered in order to avoid colliding with a deer in the roadway, but then struck a utility pole while making the maneuver, damaging the pole, police said.

Following the collision, Nezvesky drove the damaged auto to his home and then informed police at 3:14 am of the incident, police said.

Nezvesky was not injured in the collision, police said. Police said they issued Nezvesky an infraction for making a restricted turn.

Moving Violations

Police said that while on patrol about 10 pm January 5, they stopped motorist Brian Duffy, 21, of 3 Tanglewood Lane on South Main Street, near Lovell’s Lane, because the vehicle that he was driving had a headlamp that was not lit.

After investigating, police charged Duffy with failure to have a working headlamp and with driving with a suspended license.

Police said they released Duffy on a written promise to appear in court on January 21.

Mailbox Hit

Police report that at about 8:30 pm January 4, an unknown vehicle that was traveling eastward on Riverside Road went off the right side of the road and struck a curbside residential mailbox in front of 100 Riverside Road, knocking down the mailbox, after which the vehicle left the scene.

 Police provided no description of the offending vehicle. Police ask anyone with information on the incident to contact the police telephone tip line at 270-8888.

Four Charges

Police said they received a complaint about noise coming from a vehicle in the parking lot at 100 Church Hill Road in Sandy Hook Center about 1:20 am January 7, so they went to the area to investigate.

Police said they located the vehicle in question and determined that its driver, who was sitting in the vehicle with its engine running, was impaired by the use of alcohol.

Thus, police arrested motorist Peter Joy, 34, of 9 Skidmore Lane on a charge of driving under the influence.

Police said they also held an outstanding warrant for Joy in connection with a November 9 road rage incident on Route 302 in which he allegedly smashed another motorist’s windshield.

In that warrant, police charged Joy with intent to harass by following another vehicle too closely, breach of peace, and second-degree criminal mischief.

After Joy posted $100 bail, he was released for a January 22 court appearance, police said.

Moving Violations

Police said they stopped motorist JoAnn Kenyhercz, 50, of Shelton near 173 South Main Street about 3 pm January 2 to investigate.

Police said they charged Kenyhercz with failure to drive to the right and with driving with a suspended license.

After she posted $250 bail, police released Kenyhercz for a January 16 court appearance.

Two Vehicles

About 1:47 pm January 2, motorist Joseph Fowler, 50, of Little Brook Lane was driving a 2005 Volkswagen station wagon southward on South Main Street behind southbound motorist Michael Brower, 48, of Wills Road, who was driving a 1992 Chevrolet van, police said.

Police said the Volkswagen struck the Chevrolet from behind. There were no injuries.

Police said they issued Fowler a written warning for failure to drive a reasonable distance apart. Police said they gave Brower a misdemeanor summons for failure to have automotive insurance.

Butterfield Road

About 8 am January 6, motorist Mark Lurie, 43, of 131 Hanover Road was driving a 1999 Isuzu Rodeo westward on Butterfield Road, as motorist Marcela Luci-Bernard, 40, of 63 Butterfield Road was driving a 2003 Volkswagen Eurovan eastward there, police said.

Both vehicles then simultaneously attempted to negotiate a sharp blind curve on the narrow road and collided near 47 Butterfield Road, police said.

There were no injuries. Police said they verbally warned Luci-Bernard for failure to carry a vehicle registration.
