Man Seeks Money

Damages For Fall

A local man has filed a lawsuit against the town seeking money damages in connection with his being injured in a fall while walking on a town road in August 2002.

In a personal injury lawsuit filed in Danbury Superior Court on October 31, Sedali Sedaliu of 152 South Main Street seeks money damages exceeding $15,000 as legal compensation for injuries he received.

According to the lawsuit, at about 1 pm on August 4, 2002, Mr Sedaliu was walking on Eagle Rock Road, a dirt road that extends from Dayton Street in Sandy Hook Center.

While walking on Eagle Rock Road, about 35 feet from its intersection with Dayton Street, Mr Sedaliu tripped and fell in and over a depressed and collapsed section of Eagle Rock Road, according to the legal papers. The road damage reportedly was caused by stormwater runoff.

The lawsuit claims that the town was careless and negligent for not keeping the road in proper repair and reasonably safe for pedestrian use. The town failed to properly mark the damaged area to restrict pedestrian access to it, and also failed to warn pedestrians of the damaged road, the suit adds.

In the fall, Sedaliu received a broken right ankle, swelling, plus shock and stress to his nervous system, it adds. The injury resulted in medical bills, it states. The lawsuit claims the injury resulted in limitations on Mr Sedaliu’s ability to work.

Attorney Patrick Filan of Westport represents Mr Sedaliu. The town has a December 9 court return date in the case.
