To the Editor:
Letters previously written to the Letter Hive have suggested that Planning and Zoning Commission (PZC) decisions could be modified by either the legislative body of the town or by voter referendum.
In Robert A. Fullerâs book Land Use Law and Practice published by Thomson in 1999 and revised in 2005, attorney Fuller states, âOnce the zoning commission is established and commences its functions, it is not subject to interference by the legislative body of the municipality or any type of referendum.â There is ample case law supporting this statement.
I hope this adds some clarity to the recent discussion about land use.
