Prospect Woman Seeks Money Damages For Carnival Fall

A law firm has submitted a client’s claim for unspecified money damages to the town, charging that the town was negligent when a Prospect resident tripped and fell in the parking lot at Newtown High School while she was attending a firefighters carnival there in April.

Attorney Robert S. Kolesnik, Sr, of Kolesnik & Norris of Waterbury, in a July 11 letter to the town states that the law firm is seeking damages on behalf of Mariel Walters of Prospect.

Mr Kolesnik sates that the incident occurred about 8 pm on April 21. The lawyer states that Ms Walters received arm, wrist, foot, and knee injuries, among other problems, due to the incident.

The lawyer adds that Ms Walters was injured when “she tripped over a wrinkled-up black rubber mat covering electrical wires which ran across the designated walk area of black asphalt…It was dark out and the visibility of the surface of the black asphalt was poor due to the poor lighting,” the lawyer states.

The lawyer charges that the situation created a tripping hazard that resulted in Ms Walters’ injuries.

The Board of Selectmen’s agenda for its August 1 meeting lists the personal injury damage claim as a topic for discussion in executive session.
